The people who are Lolita's captors – the Dolphin Company - have ignored the advice of a veterinary doctor and continue to put her in danger. The sanctuary pen was planned to be hundreds of time larger than her Miami house and surrounded by ocean, not concrete tanks.

If the plan had been successful, Lolita (also called Tokitae or Toki) could be alive. In the wild killer whales are extremely social animals that are bonded with family members until they die. Since her captor does not have to divulge this information, it's unclear what health issue the orca is suffering from. The Orca Project created a repository of necropsies from Sea World. This shows that kidney diseases often play an integral role in the deaths of orcas kept in captivity.

Despite the ongoing health issues there is a lot of hope that Lolita could be closer to living in the wild than before. Seaquarium's new owner Seaquarium has stated his commitment to transfer the whale out of her tank into her native waters in the Pacific.

Cook.jpgThe move comes following years of public pressure and demands, including from PETA, that the Miami Seaquarium release Lolita into a sanctuary at sea where she could swim deep in the ocean, and possibly even be reunited with the orca believed to be her mother. These plans were too late to save the whale, which died on Friday as a result of what was believed to be a kidney issue.
